(“ProfitNow”), you entrust us with information about you, your company, and/or your clients that is personally identifiable and not otherwise publicly available. At ProfitNow, one of our top priorities is making sure that the information that we have obtained from you about you, your company, and/or your customers is protected and secure. ProfitNow’s obligations under this Privacy Policy only cover the electronic data that ProfitNow collects from you, your company, and/or your clients in the course of providing the Services to you. Without limiting the foregoing, this Privacy Policy does not apply to (i) any data collection or processing, including, without limitation, data collection by any non-ProfitNow owned web pages to which the Services may link, or (ii) any data that ProfitNow or any third parties may collect offline or through web sites, products, and/or services for which ProfitNow has not displayed this Privacy Policy or authorized a direct link to this Privacy Policy. By accessing and/or utilizing the Services, you accept the current version of this Privacy Policy at that time.

WHAT INFORMATION ProfitNow COLLECTS FROM YOU

ProfitNow collects two (2) basic types of information about you, your company, and/or your clients in connection with the Services.

1. “Personal Information.” Personal Information refers to information containing the specifics of who you, your company, and/or your clients are that ProfitNow and its agents may use to identify, contact or locate you, your company, and/or your clients. This could include, among other things, names, mailing addresses, telephone numbers, and e-mail addresses.

2. “Non-Personal Information.” Non-Personal Information refers to information that, by itself, does not identify you, your company, or your clients as a specific entity or individual. ProfitNow may collect Non-Personal Information through any of the methods discussed above as well as automatically or otherwise through your agents’ use of the technologies described in this Privacy Policy. You understand that any information that you or your agents voluntarily place in a public forum shall not be considered to be Personal Information or private.

HOW ProfitNow COLLECTS INFORMATION FROM YOU

ProfitNow may collect Personal Information when you, your company, and/or your clients use the Services including, without limitation, registering for Services, creating and maintaining accounts, filling out surveys, submitting an inquiry through the website, through cookies, log files, third-parties (such as Google Analytics), corresponding with ProfitNow, or otherwise volunteering information about you, your company, and/or your clients. Our primary purposes in collecting this information are to provide you with a customized, efficient, and easy to use experience when using the Service and to better understand how users access and use the Services to provide offers and make improvements.

HOW ProfitNow USES YOUR INFORMATION

ProfitNow may use Information collected from you, your company, and/or your clients in the following ways:

1. System Administration and Providing Services. ProfitNow may use Personal and Non-Personal Information in furtherance of providing you, your company, and/or your clients with the Services and administering, supporting, protecting, and improving the Services and for purposes of communicating with you and your agents. ProfitNow may use Personal and Non- Personal Information to bill and collect fees for the Services. ProfitNow never stores credit card data on our servers.

2. Notices to Customers. ProfitNow may use Personal Information to send e-mails to you and/or your agents related to the Services (including your accounts thereunder), including confirmation to verify the accuracy of any information you and/or your agents have provided and to provide any instructions or assistance related to the Services and/or your (or your agents’) use thereof. ProfitNow may also send emails to you and your agents to verify your respective identities and/or to notify you and your agents if ProfitNow believes your (including your agents’) use of the Services violates any applicable agreement between you and ProfitNow related to the Services. ProfitNow may occasionally send you 1) special offers or updates (i.e. newsletters) pertaining to the Services, 2) service announcements and notices of scheduled downtime or service upgrades, and 3) to respond to requests, inquire about experiences with the Services, and provide support..

3. Combining Data. To the extent permitted by applicable law, ProfitNow may combine the various types of data that ProfitNow collects with other data that ProfitNow collects from you, your agents, and ProfitNow’s other customers and business partners.

DISCLOSURE

ProfitNow may disclose Personal Information under special circumstances, such as when required by law or when your actions violate our Terms of Service. In addition, in the event ProfitNow goes through a business transition, such as a merger or acquisition with or by another company, your information will, in most cases, be transferred to the new company. ProfitNow takes every precaution to protect all private information. When users submit sensitive information via the Site, or through the Services, their information is protected via industry- standard SSL encryption. We also do everything in our power to protect user-information offline.
